Terms and Conditions

1. Agreement and authority

These Terms govern access to the Promage dashboard. You may use Promage only if you are authorised by a subscribing organisation, can form a binding agreement, and accept these Terms. You must provide accurate account information and use the service only for lawful business purposes.

2. Accounts and acceptable use

  • Keep credentials confidential, use your own account, and notify your administrator of suspected compromise.
  • Do not bypass permissions, access another company or site, scrape the service, introduce malicious code, disrupt availability, reverse engineer protected components, or use Promage to violate law or another person’s rights.
  • Do not enter personal, biometric, payroll, GPS or confidential information unless your organisation has authority, a defined purpose and appropriate notices or consent.
  • Review automated calculations, reports and AI-assisted answers before relying on them. Promage assists authorised workflows but does not replace professional, legal, payroll, safety, accounting or engineering judgment.

3. Customer data and responsibilities

The subscribing organisation retains responsibility for the legality, accuracy, quality, retention and authorised use of data it supplies. It grants Promage the limited right to host, process, transmit, back up and display that data as needed to provide and secure the service. Promage does not acquire ownership of customer data.

4. Service operation and third parties

Features may depend on hosting, email, mapping, GPS, document, payment or AI providers. Promage may maintain, update or reasonably change the service, and will use reasonable efforts to protect continuity. Planned or emergency maintenance, provider failures and events beyond reasonable control may affect availability.

5. Fees, suspension and termination

Package limits, fees, payment terms and subscription duration are governed by the customer agreement. Access may be restricted or suspended for non-payment, security risk, unlawful use, material breach or protection of users and data. On termination, data handling and export are subject to the customer agreement, legal retention duties and the Privacy Policy.

6. Intellectual property

Promage and its licensors retain rights in the platform, branding, interfaces, documentation and underlying technology. These Terms grant only a limited, revocable, non-transferable right to use the service within the subscribing organisation’s authorised scope.

7. Warranties and responsibility

The service is provided with reasonable skill and care and subject to applicable law and the customer agreement. Users remain responsible for reviewing source data, permissions, statutory submissions, payroll outputs, contracts, safety decisions, GPS interpretations and operational actions. Nothing in these Terms excludes liability that cannot lawfully be excluded, excuses fraud or gross negligence, or removes mandatory consumer or data-protection rights.

8. Privacy

The Privacy Policy explains personal-information processing and forms part of these Terms. Optional cookie consent is separate and may be refused without preventing essential authenticated service functions.

9. Changes and governing law

Material changes receive a new version and may require acceptance at the next login. These Terms are governed by the laws of the Republic of South Africa. Disputes follow any process in the applicable customer agreement and the jurisdiction of competent South African courts.
